A break and enter suspect is a free man after a judge acquitted him due
to an improper search and seizure by Kenora Police.
24-year-old Clifton Zoccole faced two counts of break, enter and theft
after being picked up following robberies back in April.
Justice Donald Fraser acquitted him on both counts after ruling key
evidence would be excluded.
Defence lawyer David Gibson successfully argued that his client’s
rights were violated when he was searched prior to being arrested.
Crown attorney Peter Keen said he couldn’t proceed with
Wednesday’s trial without the evidence.
