The Doug Ford government is taking the federal government to court to prevent a new carbon tax being imposed on the province.
Attorney General Caroline Mulroney made the announcement Thursday morning.
Mulroney says they were elected with a clear mandate to stand up for the people of Ontario who don’t what a carbon tax, so they are bringing this reference to the Ontario Court of Appeal.
She says it’s their position that this tax is unconstitutional and outside of federal jurisdiction.
Mulroney says they are joining Saskatchewan in issuing the court challenge and she says Ontario has budgeted $30-million for the challenge.
She says she is very confident that it will cost significantly less than that, noting they plan on using in-house lawyers.
Environment Minister Rod Phillips says the Conservatives ran to get rid of the carbon tax and they are intent on keeping that promise.
Phillips says provinces should have oversight in this area, stressing Ontarians have made it clear they don’t want the tax.
Manitoba also looked at legal advise and discovered that the federal government does have the power and right to impose a carbon tax.
