Adam Leon is heading back to court in October.
The ex-Confederation College student is charged with theft following an incident where a Cessna aircraft was taken from the college flight school in Thunder Bay and flown into the United States.
Lawyer Neil McCartney feels Leon shouldn’t be tried in Canada since he was already charged and served time in the United States.
McCartney is asking the court to consider Leon’s situation as “double jeopardy.”
