The blanket smoking ban issue in the Kenora District has taken another twist.
Ontario’s Ministry of Attorney General has applied for a judicial review of the February ruling that determined the Medical Officer of Health overstepped his boundaries in implementing a no-smoking order.
The Ministry wants Superior Divisional Court to toss out the Appeal and Review Board decision and order them to reconsider the case.
The application states the Board made errors in its interpretation of the Health Services and Promotion Act, in arriving at its final decision.
